This document contains IDEA LAB Ltd's general terms and conditions for using the website https://giftcometrue.com/ and the conditions for purchasing and using gift vouchers for experiences.

Please read the information below carefully before browsing our experience offers or purchasing a gift voucher. It outlines your rights and obligations to IDEA LAB Ltd. and the terms and conditions for using our services.

Using the Platform and purchasing Experience Vouchers signifies that you know and accept these Terms and Conditions. When placing an order through our platform, you must explicitly confirm your agreement to this document's terms by ticking the relevant box when completing the order.

We reserve the right to occasionally update these Terms and Conditions to reflect changes to our services and legislation. We will notify you of material changes by email or notice on our website.

We would like to draw your special attention to the fact that:

  1. Experience vouchers have a set validity period
  2. Booking a specific date and time is a prerequisite for using most experiences
  3. Some activities may have specific age, fitness, or health requirements
  4. In certain weather conditions, some outdoor experiences may be postponed

Section I - General Information about the Administrator. Terms used.

Art. 1 (1) Information according to the Electronic Commerce Act and the Consumer Protection Act:

Art. 2 (1) For these General Terms and Conditions, the following terms shall be interpreted and understood per the definition given for each.

  1. The platform administrator, or just "Administrator," is the legal entity that owns the exclusive copyrights to the Gift Come True platform and its content. The Administrator acts as an intermediary between the contractor and the client, enabling them to conclude a contract without the contractor being a party. 
  2. Account - a website section formed by a username and password that allows a Customer to place an order. Each account contains information about the visitor who registered it and the history of some of his actions on the website, such as personal data, previous orders, favorite products, etc. Each user is responsible for ensuring that all information entered into the account is correct, complete, and up-to-date;
  3. Contract - is the contract concluded remotely between the Contractor and the Client for the purchase and sale of services through the platform owned by the Administrator, and an integral part of this contract are these General Terms and Conditions of Use, which shall apply insofar as it does not regulate otherwise. 
  4. Request - an electronic document representing a communication form sent by the Customer to the Administrator via the Platform, through which the Customer expressly declares their wish to purchase a gift voucher for a selected experience. The request shall contain the essential elements of the contract, including the type of experience chosen, the number of vouchers, the method of receipt of the voucher (electronic format or luxury gift wrapping), a personalized message to the recipient (if applicable), the preferred design of the voucher (where choices are available), details of the recipient and the payer.
  5. "Experience Voucher" - an electronic or physical document with a unique identification code issued by the Administrator that entitles the bearer to receive a specific product or service from a Platform Partner. The voucher contains:
  • Unique identification number
  • A QR code leading to a description of the experience with conditions current at the time of purchase of the experience voucher
  • validity period (12 months from the date of purchase unless explicitly stated otherwise)
  • terms of use
  • personalized message (if requested by the customer)
  • booking instructions
  1. Customer—is defined as any natural person at least 18 years of age with the legal capacity, any legal entity represented by its representatives, or any other legal entity that is a party to at least one distance purchase contract concluded through the Platform. 
  2. Gift card—a personalized payment instrument with a unique identification code issued by the Administrator, "IDEA LAB" Ltd., which entitles the bearer to select and receive one or more experiences from the platform up to the charged value or by additional payment if the value available in the gift card is not enough to purchase the selected product or service from the platform. The Gift Card is a universal solution, allowing the recipient complete freedom to choose from all the experiences available on the platform. 
  3. Marketplace - a web-based platform (in short, the Platform) that connects third parties, namely service providers (merchants) and visitors who wish to enter into a purchase contract remotely. In it, the administrator is not responsible for the completeness and truthfulness of the information provided by the merchants about the services and products subject to the distance contract.
  4. Discounted price—This is offered by the Administrator, which is lower than the usual price and is a reference for discounts. It is based on the lowest price the Administrator advertised for the last 30 days before introducing the discount on the Goods in our online shop. 
  5. Password - a combination of letters, numbers, or symbols associated with a specific username that a visitor uses to access their account; 
  6. Visitor - an individual who has visited the platform by entering the domain;
  7. Selling price - this is the final price, including VAT and all other taxes and fees, that the customer must pay to acquire the right to receive a specific service or product unless there are additional conditions for the use of the service that are explicitly described in the platform, including those related to additional payments to the contractor on site, such as tour fees, etc.
  8. Working Hours - shall be every working day within the hours 09:00 - 17:00, except for days designated as public holidays under the provisions of the Labour Code and those specifically designated by the Administrator as non-working;
  9. Registered User - any natural person at least 18 years of age with legal capacity, any legal entity represented by its representatives, or any other legal entity that has created and maintained an active account on a Platform. The registered user provides personal information following the privacy policy and has special rights and obligations; 
  10. "Delivery Time" means the period between confirmation of successful payment and receipt of the recipient's requested gift voucher or Gift Card. The period varies depending on the customer's delivery method, whether electronic (via email) or physical (via freight forwarder). With electronic delivery, receipt is almost immediate - within 15 minutes after successful payment is registered. When choosing physical delivery, the term is up to 2 working days for locations with courier coverage on the territory of Bulgaria, except in cases where the courier company does not tolerate delays, for which the Administrator is not responsible.
  11. Contractor - A legal or natural person who has gone through the Administrator's approval process and the parties have signed a commercial representation agreement. 
  12. Review - a written evaluation by a customer who has purchased an experience voucher or a Gift Card from our platform, based on personal experience, expressing an opinion as to whether the product meets the features specified by the contractor, as well as the overall experience of using the platform, including the quality of the information society services provided by the Administrator.
  13. Commercial messages - any type of message sent through electronic communication channels (such as email, SMS, notification, etc.) or through an image and/or text on the platform, which contains general and thematic information on available promotions, discounts, discounts for individual products, as well as for entire categories or subcategories offered by one or a group of merchants. 

Section II - General characteristics of the marketplace. Conclusion of a distance sales contract.

Art. 3 (1) Gift Come True is a specialized online experience voucher platform that connects users with professional providers of various experiences in and outside Bulgaria. The platform provides the following core functionalities:

  1. Detailed presentation of each experience with a detailed description including duration, location, activities included, and conditions required based on information provided by the Contractor;
  2. Easily search for experiences through intuitive filters by category, price, location, number of recipients, and more;
  3. Quickly and securely purchase experience vouchers or gift cards with a pre-selected value;
  4. Direct communication with our team regarding bookings, changes, and questions related to a specific experience;
  5. Personalise gift vouchers with an individual message;
  6. Sending a request to exchange a voucher within its validity period;
  7. Possibility to request online booking of the selected experience;

(2) These Terms and Conditions govern the legal relationship between the Platform Administrator, the Merchan, ts, and the End Users. Any use of the Platform, whether involving purchase or browsing only, is bound by these Terms. Amendments and additions are permissible only in the cases expressly indicated in this document.

(3) The administrator shall act as an intermediary between users and experience providers by providing a secure environment for selecting, purchasing, and submitting experience booking requests. Our partners, verified professional providers of the relevant services, provide all experiences.

(4) The platform carefully selects its partners and maintains a quality control system for the experiences provided.

Art. 4 (1) To optimally use the platform and take advantage of all the advantages in selecting and purchasing experiences, visitors must create a personal account through self-registration.

(2) To create an account, the following data must be provided:

  1. Name and surname of the account holder;
  2. Valid e-mail address for correspondence;
  3. A secure password containing letters, numbers, and characters;

(3) The registered user is fully responsible for the accuracy and timeliness of the data provided. If personal data changes, the user must update it within 7 days via the settings in his account.

(4) The registration process requires explicit consent to these Terms and Conditions and the Privacy Policy by actively checking the appropriate boxes. By this action, the user declares that they are thoroughly familiar with their contents and undertake to comply with the established rules when using the platform.

(5) The account creation is finalized by clicking the "Register" button, after which the account becomes active.

(6) The Administrator reserves the right to refuse or terminate registration for:

  1. Providing false data
  2. Using the abuse profile
  3. Breach of these Terms and Conditions
  4. Compromising platform security

Art. 5 (1) The purchase of experience vouchers or Gift Cards is available to visitors and users with an active account on the Platform who log in with their login details (email and password).

(2) The voucher purchase process includes the following sequential steps:

  • Choosing the desired experience or a gift card and determining:
      1. number of vouchers
      2. preferred voucher design (where options are available)
      3. method of receipt (electronic or physical format)
      4. personalized message to the recipient (optional)
  • Overview of the order in the basket, including:
      1. details of the selected experience/gift card
      2. total value of the order
      3. applicable discounts or promotional codes
      4. physical delivery fee (if applicable and if such an option is selected)
  • Entering delivery information:
      1. for electronic delivery, email 
      2. for physical delivery: delivery address or choice of forwarding office 
      3. contact details 
  • Issuance of an expense voucher (optional):
      1. for a natural person: name, ID number, address
      2. for a legal entity: company details, UIC, registered office address
  • Choice of payment method:
      1. bank transfer 
      2. by card payment via a virtual POS terminal
      3. with available promo code or gift card
      4. cash on delivery for physical vouchers or physical gift cards
  • Finalizing the order:
    1. overview of the entered information
    2. confirmation of agreement to the Terms and Conditions and Privacy Policy
    3. completing the order via the "Complete Order" button

(3) After the successful completion of the order, the platform is automatically generated:

  1. confirmation email with order details
  2. unique tracking number
  3. electronic voucher (upon selection of electronic delivery and registration of successful payment by the Administrator)

(4) The distance contract shall be deemed to have been concluded upon completion of the order and registered payment thereof. 

(5) The Administrator reserves the right to refuse to execute an order if:

  1. Suspicions of misuse of foreign payment data
  2. Violation of promotional codes
  3. Other valid reasons for which the customer will be notified within 24 hours but no later than the first working day following the day of the order.

(6) In the event of cancellation of an order for any of the above reasons, the amount paid for the experience shall be refunded in full within 14 calendar days using the original payment method. Packaging and shipping (if the order includes the same) will not be refunded.

Art. 6 (1) A party to the contract for the purchase and performance of an experience is a specific Contractor who will provide the service. 

(2) Traders who are party to the contract and responsible for the performance declare that:

  1. have the necessary qualifications and legal capacity
  2. have valid permits and insurance
  3. have the capacity to deliver the experience within the timeframe requested by the client
  4. will comply with all safety and service quality standards

Art. 7 (1) All prices on the platform are in Bulgarian lev and include VAT. Payment for the selected experience or a Gift Card is possible through:

  1. Online bank card payment via Stripe payment processor
  2. Activation of a pre-purchased Gift Card
  3. Using a promotional code 
  4. Payment by bank transfer to a bank account specified by the Administrator
  5. Payment by cash on delivery

(2) For each payment made through the system (when requested and excluding cash on delivery), an expense document shall be generated:

  1. Documents are sent to the email address provided within 48 hours of successful payment, within business days.

(3) To issue an expense justification document (invoice or report) to a legal entity, you must mark this option before finalizing the payment and entering up-to-date company details. 

(4) When paying with a Gift Card:

  1. its value may be partially or fully used
  2. the remaining amount of the Gift Card remains available for future purchases within the validity period of the Gift Card
  3. if a higher-value experience is chosen, the difference can be paid by bank card or bank transfer to the Administrator's bank account.

Section III - Categories of users on the platform and their rights and obligations

Art. 8 The Gift Come True Platform distinguishes the following three main categories of users:

  1. Visitors - persons who browse the platform without having created an access account
  2. Registered users - persons with an account on the platform
  3. Customers - persons who are party to a contract for the purchase and sale of an experience voucher or a Gift Card through the Platform

Art. 9 Visitors have the following fundamental rights:

  1. Browse the entire catalog of experiences and their detailed descriptions without limit;
  2. Read posts in the Blog section for unique gift ideas and unforgettable experiences;
  3. Use the full functionality to search and filter experiences by different criteria;
  4. For direct contact with the Administrator's team regarding additional information, expert assistance in concluding a distance purchase contract, or establishing a partnership, 
  5. Create a personal account on the platform with individual settings and preferences;
  6. Share constructive feedback to improve the functionality of the platform;
  7. To receive a periodic newsletter with up-to-date offers if explicitly requested;
  8. To report on times when violations of intellectual property rights are detected;

Art. 10 Visitors have the following essential obligations:

  1. To strictly comply with these Terms and Conditions in all interactions with the Platform and its content;
  2. Not to carry out malicious actions that hinder the normal functioning of the online platform or to violate the rights of third parties, including traders;
  3. Do not attempt to gain unauthorized or malicious access to system components, databases, and personal data;
  4. Not to copy, modify, or distribute any content owned by the Administrator that is available on the Platform, including photos, images, text, or descriptions, without the express written permission of the Administrator;
  5. Fully respect the intellectual property rights of all elements of the platform;
  6. To use the provided functionalities only for their regulated purpose;
  7. To keep in the strictest confidence any sensitive information received from the Platform;

Art. 11 In addition to the rights of visitors, registered users shall enjoy the following extended rights:

  1. Priority access to exclusive seasonal promotions and special price discounts
  2. Detailed tracking of the complete history of purchased vouchers with all details
  3. Get personalized offers according to individual preferences

Art. 12 Registered users, in addition to the obligations of visitors, have the following specific commitments:

  1. To keep all information entered in their profile strictly up-to-date
  2. To store securely and not share under any circumstances their account credentials
  3. Take full responsibility for all actions performed through their account
  4. Notify the administrator immediately upon the slightest suspicion of unauthorized access to the account
  5. To use the provided additional functionalities according to their intended use

Art. 13 In addition to the rights of visitors, customers enjoy the following extended rights:

  1. Receive comprehensive information about all aspects of the purchased experience, including specific requirements
  2. Request expert assistance in selecting a date and arranging the booking
  3. Receive priority technical and organizational support when difficulties arise
  4. To request the issue of all necessary supporting documents in the preferred format
  5. Participate in the exclusive loyalty program with additional benefits when registered users

Art. 14 In addition to the obligations of visitors, customers have the following specific commitments:

  1. To strictly comply with the terms and conditions for booking and using the purchased experience to benefit from the experience voucher or the Gift Card;
  2. To pay, by the chosen method, the remuneration due to the Platform Administrator;
  3. Visit a freight forwarder's office to receive the voucher or Gift Card if ordered as a physical product with delivery to a freight forwarder's office; 
  4. To inform the contractor in due time in case of objective impossibility to carry out the planned reservation concerning the specified deadlines for change or cancellation of the reservation;
  5. Carefully check the validity and terms of vouchers received before activating or using them;
  6. To properly store all activation codes provided for purchased experiences;
  7. To detail to the final recipients of gift vouchers all terms and conditions of use;
  8. Show up precisely at the pre-arranged time and place for the experience;
  9. Strictly follow all safety instructions specific to the particular expertise;
  10. Protect the commercial confidentiality of any correspondence with the Platform and its partners (merchants);
  11. Provide up-to-date contact details in the event of a change to those originally provided;
  12. Notify immediately if there are any problems or concerns about the quality of the experience;

Section IV - Rights and Obligations of the Administrator

Art. 15 The Administrator shall have the following rights concerning visitors, registered users, and customers:

  1. Suspends or restricts access to the platform to a group of visitors or a specific visitor, registered user, or customer for technical reasons, maintenance,e or suspected abuse, including in case of violation of these terms and conditions;
  2. Changes the functionality, design, and structure of the platform without prior notice to visitors;
  3. To receive in advance the quoted price of all goods in the basket, provided that the method chosen is payment by card (credit or debit) or bank transfer. Provided that the selected payment method is cash on delivery, be entitled to receive the price of the physical products ordered, but no later than 7 days after the date of their dispatch;
  4. Sends information and marketing messages to registered users;
  5. Collects and analyses statistical information about the use of the platform, including information collected through cookies, to improve the services and user experience;
  6. Conclude distance sales contracts with customers on behalf and for the account of a contractor
  7. Removes or edits content that violates these rules, applicable law, or the rights and interests of third parties without prior notice to visitors;
  8. Refuses to execute orders in case of suspected fraud, abuse, or unclaimed COD shipment for a past period without giving a specific reason for the refusal;
  9. Enter into partnerships with third parties (merchants) to provide new experiences or services;
  10. To suspend the offer of particular experience vouchers or other products temporarily or for an extended period, in the event of objective impossibility or other circumstances, without expressly notifying the parties concerned; 
  11. Conducts promotional campaigns and special offers following applicable law;
  12. To use the comments, reviews, and ratings of registered users to promote the online store;

Art. 16 The Administrator undertakes the following concerning visitors, registered users, and customers

  1. Maintains the platform in working order and ensures regular access to functionality;
  2. Protects users' data following applicable law;
  3. Processes customer orders and requests correctly and on timer;
  4. Provides up-to-date information on products, services, and terms of use;
  5. It shall consider inquiries, complaints, and suggestions received on time;
  6. Includes information on the status of orders and transactions;
  7. Keeps up-to-date stock and price data;
  8. Notifies of changes to the terms of use;
  9. Offers alternative solutions in case of inability to fulfill an order;
  10. Provides the ability to opt out of marketing messages;
  11. Assist in the resolution of disputes between stakeholders and traders;

Section V - Conditions for Vouchers and Gift Cards

Art. 17 (1) The Administrator shall ensure the delivery of the purchased experience vouchers and gift cards in two ways:

  1. E-delivery: sending the voucher in PDF format to a specified email address within 15 minutes of payment confirmation;
  2. Physical delivery: sending the voucher via the selected freight forwarder;

(2) When choosing physical delivery, the customer may choose:

  1. Delivery to a specific address (home, office, or other location);
  2. Delivery to an office or vending machine of selected forwarder 

(3) The service for delivery by forwarder shall be performed only on the territory of the Republic of Bulgaria.

(4) The conditions for selecting a specific freight forwarder shall be determined individually by the Administrator or the Contractor, who shall have the right to decide whether to give the customer a choice of multiple freight forwarders or to deliver through a freight forwarder of their choice.

Art. 18 (1) In case of a technical problem generating an electronic voucher, Gift Come True shall issue the voucher manually within 24 hours. Still, no later than the first working day following the day the problem occurred.

(2) If executing the order is impossible, the Administrator will offer an alternative option. At the customer's request, the prepaid amount will be refunded within 14 calendar days using the same method used for the initial payment or a bank account submitted by the customer who placed the order.

Art. 19 (1) The standard delivery time by forwarder is 1 to 5 working days. During national holiday promotional campaigns, the deadline may be extended by up to 3 working days. The delivery time depends entirely on the freight forwarder, and the Administrator shall not be held liable for any delivery-related delay. 

(2) In case of incomplete delivery data, the customer receives a notice of the need for correction by the Administrator. The Administrator is not responsible for incorrectly filled-in delivery data by the customer.

Art. 20 (1) Upon receipt of a physical voucher, the recipient shall:

  1. Check the integrity of the gift packaging
  2. Confirm the availability of all requested products
  3. Make sure the personalized message is correct
  4. Check the voucher validity period

(2) Upon acceptance of the shipment, the voucher is deemed delivered in good condition, and no defects can be claimed.

Section VI - Cancellation and Refund Conditions

Art. 21 (1) A customer may cancel a purchased experience voucher within 14 calendar days from the date of purchase. This right applies only if the customer has not activated the voucher by entering the validation code, has not made a reservation for a specific date with the Contractor, and the experience is not in a category excluded from the right of withdrawal.

(2) To exercise the right of withdrawal validly, the customer must send a withdrawal form to the specified contact email of the Administrator, indicating the order number, the reason for withdrawal, and the preferred method of refund. The form can be downloaded from the "Attachments" section of these General Terms and Conditions or sent upon request. 

(3) The right of withdrawal shall not be deemed validly exercised through a telephone conversation or correspondence via social networks with a representative of the Administrator.

Art. 22 Customers cannot exercise the right of withdrawal for the following categories: gift cards with a pre-loaded value, experiences with a fixed date such as events, concerts, and courses, group experiences with a predetermined number of seats, vouchers with a personalized design at the customer's request, items from the 'personalized' section, seasonal experiences during peak periods, or products and services explicitly stating this restriction in their description, including products and services from the “BeSpecial” product category.

Art. 23 (1) If a cancellation of an experience is approved, the customer who placed the order will receive a refund to the original payment method or the bank account they provide within 14 days of approval. Any costs incurred for shipping and packaging a physical voucher, if applicable, will be deducted. The refund will be issued only to the person who made the original payment.t

(2) The following specific conditions shall apply to refunds: for payments by bank card, the amount shall be refunded directly to the card used for the purchase; for payments by bank transfer, the amount shall be refunded to the bank account specified by the customer, and for payments by cash on delivery, the amount shall be refunded only to the bank account specified by the customer.

Art. 24 (1) The client may modify an experience reservation already made, provided that the following conditions are met: the modification is requested no later than 72 hours before the initially booked date or within the time limits submitted by the service providers as described in the offers, an alternative date is available in the contractor's calendar and explicit confirmation of the possibility of modification is received from the latter. 

(2) The right to change the reservation does not apply to experiences with a fixed date in the offer.

(3) In the event of objective impossibility to use the voucher due to the fault of the Merchant or the Administrator on the reserved initial date, the customer may choose between the following options: transfer of the voucher to a third party by written notification to the Administrator, extension of the validity period, only and only with the express consent of the Contractor.

Section VII - Conditions for exchanging experience Vouchers or extending their validity 

Art. 25 (1) Each experience voucher can be exchanged once within its validity period for another voucher(s) from the Gift Come True portfolio. Upon replacement, the new voucher(s) will retain the original voucher's validity period, during which a booking must have been made and the experience itself must have taken place.

(2) If a voucher is exchanged for one of a lower value, the price difference may be refunded in the form of a Gift Card for use on another Gift Come True purchase. If an experience of a higher value than the original voucher is chosen, the customer can pay the difference through the payment methods available on the platform.

(3)If the Contractor is unable to deliver a particular experience due to objective reasons, Gift Come True provides the client with a choice between:

  • Alternative experience in the same category with similar characteristics
  • Extension of the voucher validity period by 1 month at the Administrator's expense.

(4) The right to exchange a voucher does not apply to:

  • Fixed-date experiences - courses, events, seminars, concerts, and other activities with a predetermined schedule
  • Experiences with a limited number of booked participants
  • Vouchers with a personalized design, created according to the customer's requirements
  • Themed experiences tied to special seasons or events
  • Gift cards with pre-loaded value
  • Vouchers for personalized merchandise
  • Package offers and unique products and services on the site, the description of which expressly states that they cannot be substituted.
  • Vouchers for unique campaigns explicitly state that they cannot be exchanged. 

(5) The replacement procedure shall be carried out by:

  • Submit an exchange request via email sent to the email address. E-mail to the Administrator 
  • Indication of the identification code of the current voucher
  • Selecting a new experience and applying a link to the specific experience
  • Receive confirmation of successful exchange

(6) The Administrator reserves the right to limit the exchangeability of specific categories of experiences during peak periods or unique promotional campaigns, which will be explicitly communicated to customers in the description of the relevant experience.

Art. 26 An experience voucher may be extended by three months at the request of the bearer, provided that the following two conditions are cumulatively met:

  1. Extension request to be sent in writing to office@giftcometrue.com within the validity period of the original voucher;
  2. Additional payment of an "extension" fee of 20% of the actual cost of the relevant experience; 

Section VIII - Special clauses for consumers within the meaning of the Consumer Protection Act

Art. 27 The provisions of this section shall apply to customers who, according to the data provided upon registration or order, can be defined as consumers under the Consumer Protection Act, the E-Commerce Act, and applicable European legislation.

Art. 28 (1) Each experience on the Platform is presented with a detailed description of its main characteristics, including duration, location, included services, necessary conditions for the experience, and visual content illustrating the experience. Any visual content is purely illustrative and has minor deviations from the corresponding photo or video. 

(2) Unless expressly stated otherwise, the cost of the physical delivery of vouchers is in addition to the value of the experience. It will be determined according to the chosen delivery method and location.

(3) Customers accept that the Platform and/or electronic messages sent to the provided email address provide all information required by consumer protection legislation.

Art. 29 (1) For specific categories of experiences, especially those with booking or limited seats, the Administrator has the right to require full payment of the cost before providing the voucher and/or making a reservation.

(2) We only accept bank transfers for orders valued at more than 5,000 BGN for security reasons.

Art. 30 (1) Each user has the legal right to cancel a purchased experience within 14 days of receipt of the voucher using the standard cancellation form, subject to the conditions in Section VI.

(2) The Administrator reserves the right to refuse orders in cases of suspected abuse of the right of refusal or the case of orders in vast quantities.

Art. 31 The Customer shall be entitled to the full assistance of the Administrator in the event of any difficulties with the booking or implementation of the purchased experience, as well as access to the Customer Service Department for assistance if necessary.

Section IX - Protection of Intellectual Property. User Generated Content. 

Art. 32 (1) The "Gift Come True" platform is a unique collection of original elements, including corporate identity, visual components, textual descriptions of experiences, photographic material, design solutions, and interface, including this legal documentation. These elements are subject to exclusive copyrights belonging to the Administrator, except for expressly mentioned license agreements with other rights holders.

(2) The Administrator owns and exercises complete control over all intellectual property on the Platform, whether created by our team, submitted by Merchants, or acquired through legal licensing agreements. Access to the Platform automatically obligates visitors to abide by the established rules for using this protected content.

(3) Visitors to the Platform may view and save content for personal use without the right to distribute or modify it. Such actions should be carried out with full respect for copyright and following these terms.

(4) Using any platform elements for commercial purposes requires prior written permission from the Administrator. Any unauthorized use of protected content will be considered a serious violation of these terms and may result in legal consequences for the offender.

Art. 33 (1) The inclusion of references or links to our platform, even when citing the source, does not constitute a form of consent to the use of the content and does not grant any additional rights to the person concerned.

(2) Any use of elements of the Platform outside of those expressly permitted in these Terms and Conditions is expressly prohibited, except with the specific written permission of the Administrator.

(3) All descriptions of experiences, including text and visuals, are created specifically for the Platform and are subject to copyright. Their reproduction, distribution, or modification is prohibited.

(4) The controller shall actively protect its intellectual rights and, if infringements are detected, shall take all necessary legal action to stop them.

Art. 34 (1) To improve the quality of the products and services offered, the Administrator shall provide customers with the opportunity to post reviews and opinions on the purchased experience vouchers and gift Cards, as well as on the experiences themselves provided by the Contractors.

(2) By posting a review or opinion, the customer grants the Administrator the irrevocable right to use this content for marketing purposes for up to three years throughout the country.

(3) The Administrator reserves the right to remove or edit content that:

  1. Not relevant to the product;
  2. Violates the rules for writing in Bulgarian;
  3. Contains insults, threats, or discriminatory language;
  4. Is false or misleading;
  5. Violates trade secrets or intellectual property rights;
  6. Contains hidden advertising for other products or services provided by third parties;

Section X - Responsibility of the Administrator and Traders

Art. 35 (1) Gift Come True is an intermediary platform connecting customers with merchants who provide experiences. The Administrator is not a party to the contract for the specific experience and is not directly responsible for its performance. The merchants are entirely responsible for the quality, conditions, and parameters of the experience, including the provision of necessary equipment and safety, compliance with additional requirements, and any changes to dates or locations.

Art. 36 The Administrator shall not be liable in the following cases: 

  • In the event of force majeure, including adverse weather conditions, natural disasters, emergencies, and other similar circumstances beyond the control of the Platform that make it impossible to complete a particular experience,
  • In the event of technical difficulties leading to a temporary inability to access the platform, problems in processing payments or generating vouchers, or other system interruptions that prevent the regular operation of the platform, which occurred for reasons beyond the control of the Administrator, including the fault of third parties;
  • Circumstances relating to Merchants providing the Experiences including sudden termination of their business, unilateral change to previously stated terms, failure to meet commitments, or introduction of additional requirements of which the Administrator has not been notified promptly;
  • The administrator does not guarantee the accuracy, completeness, or reliability of the information contained in published reviews. Reviews reflect only users' opinions and do not represent the administrator's viewpoint. The administrator is not liable for any damages from using the information in the reviews.

Art. 37 (1) The administrator is responsible for the platform's correct functioning, the accurate generation and timely dispatch of electronic vouchers, and the organization of their physical delivery. The Company is committed to active mediation in disputes between customers and partners, including assistance when vouchers need to be revalidated or reservations changed.

(2) In the event of failure to comply with the above obligations, the liability of the Administrator shall be limited to the paid value of the specific voucher unless more significant damages are proven in court.

(3) Notwithstanding its limited liability, the Administrator shall actively resolve all cases arising between customers and merchants by communicating with both parties, offering alternative solutions, and assisting with refunds where warranted. The Company reserves the right to take corrective action against rogue traders, including termination of contractual relationships with them, to protect customers' interests and maintain the high quality of the experience offered.

Section XI - Protection and Processing of Personal Data

Art. 38 (1) The controller shall apply all modern technical and organizational measures to protect the personal information of its users following European and Bulgarian legislation on the protection of personal data. Personal data shall be processed on two legal grounds: to perform contractual obligations in the provision of services or based on the explicit consent of individuals for specific processing purposes.

(2) The platform's current privacy policy provides detailed information on the methods of collection, the purposes of processing, the storage periods of personal data, and the rights of data subjects.

(3) To ensure information security, communication with registered users regarding their data shall be made only via the e-mail address specified when creating the account on the platform.

(4) The provided contacts may only be used to send personalized offers and news about experiences with the prior consent of the person concerned. This consent can be withdrawn anytime via the unsubscribe link in each newsletter.

Section XII - Update of Terms and Termination of Relationship

Art. 39 (1) The Administrator reserves the right to update these Terms and Conditions as necessary to improve the services or changes in legislation. In the event of any change, the company shall notify its users through a notice on the platform, a post in the "Blog" section, an e-mail message, or on social networks.

(2) Amendments to the conditions shall come into force in one of the following ways:

  • After 14 days have elapsed from the notification, during which the user has not objected to the changes; after publication of the changes on the platform and no objection within 14 days;
  • With explicit confirmation by the user via a special function (checkbox) in the platform.

(3) Any communication regarding changes to the terms and conditions shall be sent to the email address provided by the user in their account or when the order was last placed. Receipt of such communications shall be deemed due notice.

Art. 40 (1) The legal relations between the Administrator and the interested parties shall be terminated in the following circumstances: termination of the company's activity due to legal or economic reasons, written agreement between the parties, objective impossibility of fulfilling the obligations; order of a competent state authority, systematic violation of the terms of use by the user, or other grounds provided for in the legislation in force.

(2) The Company may immediately terminate the access to the platform of a user who violates the established rules, abuses the system, harms the rights of others, or threatens the platform's security. In these cases, the Administrator shall not owe notice or compensation but undertakes to finalize orders already placed and paid for.

(3) If the relationship is terminated for any reason, all active vouchers will remain valid until their expiration date, and the Company will provide the necessary assistance for their use within three months of the termination.

(4) If the company terminates its activities, the validity period of the unlimited-value Gift Cards is limited to three months from the date of notification of termination. After this period expires, the Gift Cards become inactive, and no refund will be allowed due to the inability to use them. 

Section XVI - Final Provisions

Art. 41 (1) These Terms and Conditions govern the relationship between the Gift Come True platform administrator and all its visitors, including registered users and Customers, according to Bulgarian law.

(2) In the event of disputes, the parties shall seek a voluntary settlement through negotiation and mutual compromise. If no out-of-court settlement is reached, disputes concerning the interpretation, validity, or performance of these terms and conditions shall be referred to the competent Bulgarian court.

Art. 42 (1) The parties undertake to protect their mutual interests and not disclose confidential information that they learn through the platform.

(2) The obligation of confidentiality shall cover any commercial, technical, or financial information, including—correspondence at or in connection with the conclusion of the contract via the platform.

Art. 43 In the event of a conflict between the provisions of these General Terms and Conditions and individually agreed terms between the Administrator and a particular user, the individual agreements shall prevail.

Art. 44 (1) The assignment of rights and obligations under these terms and conditions to third parties without the prior written consent of the other party is prohibited, except in the cases expressly provided for. Any assignment violating the preceding sentence shall have no effect against the opposite party.

Art. 45 In the event of invalidation of any provision of these conditions, the remaining provisions shall remain in force.

Art. 46 These General Terms and Conditions become effective on 01.02.2025 and apply to all Gift Come True platform visitors.
